Acceptable Use Policy

This Acceptable Use Policy ("AUP" or "Policy") governs your use of Storefront AI's platform, API, and related services (collectively, the "Services").

This AUP is incorporated by reference into the applicable agreement between you and Storefront AI, Inc. ("Storefront AI"), which may be a Beta Test License Agreement, Terms of Service, or Master Subscription Agreement (each, an "Agreement"). Capitalized terms not defined in this AUP have the meanings given in the applicable Agreement.

You agree to comply with this AUP and are responsible for ensuring that your employees, contractors, agents, and any other users accessing the Services through your account ("Users") also comply.

Violation of this AUP may result in suspension or termination of your access to the Services in accordance with the Agreement.

1. Prohibited Conduct

You and your Users shall not use the Services to:

General Prohibitions

  • Violate any applicable law, regulation, or third-party rights.
  • Engage in or facilitate any fraudulent, deceptive, or misleading activity.
  • Harass, threaten, defame, or discriminate against any individual or group.
  • Promote or facilitate violence, terrorism, or the exploitation of minors.
  • Infringe, misappropriate, or violate any intellectual property, privacy, or publicity rights of any third party.

Data and Content Restrictions

  • Submit, upload, or process any Prohibited Data through the Services. "Prohibited Data" includes: (i) protected health information as defined under HIPAA; (ii) payment card data subject to PCI DSS; (iii) Social Security numbers, driver's license numbers, or government-issued identification numbers; (iv) biometric data; (v) data of individuals under the age of 16; or (vi) any other data subject to heightened regulatory protection under applicable law. If the Agreement defines "Prohibited Data," that definition controls.
  • Submit content that you do not have the right to use or that violates any third party's rights.
  • Use the Services to store, transmit, or distribute malware, viruses, or other malicious code.

Platform Integrity and Security

  • Attempt to gain unauthorized access to the Services, other accounts, or any systems or networks connected to the Services.
  • Interfere with, disrupt, or degrade the performance, availability, or integrity of the Services or any related infrastructure.
  • Conduct any security testing, penetration testing, vulnerability scanning, or load testing of the Services without Storefront AI's prior written consent.
  • Circumvent, disable, or interfere with any security, authentication, rate-limiting, or usage-limiting features of the Services.
  • Use the Services in a manner that exceeds the Usage Limits specified in the Agreement or applicable Order Form, or attempt to circumvent such limits.
  • Share, transfer, or disclose API Keys or access credentials to unauthorized third parties.
  • Use the Services from, or route traffic through, any jurisdiction subject to comprehensive U.S. economic sanctions, or on behalf of any person or entity on a U.S. government restricted party list.

AI and Model Restrictions

  • Use any Output, or any data derived from the Services, to train, fine-tune, distill, or otherwise improve any machine learning model or artificial intelligence system that competes with the Services or any Storefront AI product.
  • Use the Services or Outputs to build, develop, or operate a product or service that is substantially similar to or competitive with the Services.
  • Publish, disclose, or distribute benchmarks, performance results, or comparative analyses of the Services without Storefront AI's prior written consent.
  • Attempt to reverse engineer, extract, or reconstruct the models, algorithms, model weights, training data, or underlying architecture of the Services.
  • Use the Services to generate content designed to deceive, mislead, or manipulate, including deepfakes, synthetic media intended to impersonate real individuals without consent, or content designed to manipulate public opinion or elections.
  • Remove, obscure, or alter any proprietary notices, labels, or attributions in the Services or Outputs.
  • Represent that Outputs are human-generated when disclosure of AI involvement is required by applicable law or regulation.

Commercial Restrictions

  • Sell, resell, license, sublicense, rent, lease, or distribute access to the Services or any component thereof, unless expressly authorized in the Agreement.
  • Use the Services on behalf of, or to provide services to, third parties in a manner not authorized by the Agreement.
  • Use the Services for any purpose other than as authorized in the Agreement.

2. Usage Limits and Rate Limits

Your use of the Services is subject to the usage limits, rate limits, and other technical restrictions specified in the Agreement, the applicable Order Form, and the Documentation.

Storefront AI may modify usage limits and rate limits from time to time upon reasonable notice to you. Unless otherwise specified in the Agreement, such notice may be provided through the Documentation, the Services, or email to your designated contact.

If you exceed applicable limits, Storefront AI may, at its discretion: (a) throttle your access to the Services; (b) suspend or restrict your access, in whole or in part, until your usage returns to authorized levels; or (c) require you to purchase additional capacity under the terms of the Agreement. Any such action is without prejudice to Storefront AI's other rights and remedies under the Agreement or this AUP.

3. Monitoring and Enforcement

Storefront AI reserves the right, but has no obligation, to monitor use of the Services for compliance with this AUP.

If Storefront AI reasonably believes that a violation of this AUP has occurred or is occurring, Storefront AI may, without limitation:

  • Investigate the suspected violation;
  • Remove or disable access to any content that violates this AUP;
  • Suspend your access to the Services, in whole or in part, with or without notice depending on the severity of the violation; or
  • Terminate the Agreement in accordance with its terms.

Storefront AI will use reasonable efforts to provide notice before or promptly after taking enforcement action, except where Storefront AI reasonably determines that immediate action is necessary to prevent imminent harm to Storefront AI, the Services, or third parties.

Enforcement actions under this AUP are in addition to, and do not limit, any other rights or remedies available to Storefront AI under the Agreement or applicable law.

4. Reporting Violations

If you become aware of any actual or suspected violation of this AUP, whether by your own Users or by any other party, you shall promptly report it to Storefront AI at support@storefront-ai.com. Reports should include sufficient detail to allow Storefront AI to investigate, including, where available, the identity of the violating party, a description of the conduct, and any supporting evidence.

Storefront AI will investigate reports received under this Section in good faith and will take appropriate action consistent with this AUP and the Agreement. Storefront AI is not obligated to disclose the results of any investigation or the specific enforcement actions taken in response to a report.

5. Changes to This Policy

Storefront AI may update this AUP from time to time by posting the revised version on its website and updating the "Last Updated" date at the top of this Policy.

Where the Agreement requires advance notice of material changes to this AUP, Storefront AI will provide such notice in accordance with the terms of the Agreement.

Your continued use of the Services after the effective date of any revised version of this AUP constitutes your acceptance of the changes. If you do not agree to the revised AUP, you must stop using the Services before the effective date of the changes.
